Use of AEMO data

Has anybody ever looked into the use of AEMO data for mapping power stations etc? I can see a mention here last year: Renewables Energy Project Source but didn’t really resolve anything.

Reason for asking is that we have somebody editing PS all over Oz: Changesets by QuantPy | OpenStreetMap. When asked about sources, they have said they have used AEMO data & quoted their copyright page: https://www.aemo.com.au/privacy-and-legal-notices/copyright-permissions:
"In addition to the uses permitted under copyright laws, AEMO confirms its general permission for anyone to use AEMO Material for any purpose, but only with accurate and appropriate attribution of the relevant AEMO Material and AEMO as its author.
You do not need to obtain specific permission to use AEMO Material in this way. "

However, copyright is also mentioned on another page: AEMO | Privacy and Legal Notices: What you need to know about using our website which says:
“We, or our licensors, are the owners of all copyright and all other intellectual property rights in the contents of this website, including text and images, except where indicated otherwise. You may only use our, or our licensor’s, contents for personal use or as authorised by us or our licensors.” (My bold)

My personal feeling is that we would permission from AEMO to use their data & “only” list them on our Contributors page? Does that sound right?

I read the copyright permissions notice as allowing all use “… authorised by us …”

I’d say we don’t need extra permissions, but must list them on contributors. Best to quote the text of the Copyright Permissions with a date and link.

I’ve since sent a message to AEMO’s legal section asking these questions, but no response so far.

The Licensing Working Group has been very strict on the attribution point, and in past guidance they have preferred to have explicit permission that an attribution on the Contributors wiki page is acceptable.

AEMO ask for “accurate and appropriate attribution”, but there’s no further guidance on what they consider accurate and appropriate. If you make a map from OSM data which includes AEMO data and just attribute that as “OpenStreetMap” they may argue they require attribution alongside OpenStreetMap on that map since their data appears in the map.

It’s for mostly this reason that we obtain CC BY waivers and not just rely on the CC BY license without a waiver.

Apart from this, I also read it as applying a broad attribution only requirement akin to CC BY to all the content they publish which they also have the rights to.
