Use of openstreetmap.ng domain

According to secction 4.1. Domain names of OSM Trademark policy “You need a trademark licence to register or use a domain name that contains an OSM mark”

The past shows, that the OSMF does not enforce that at all… so why brother? I would even think OSMF is unable to do so globally.
