Should a 'shelter' be on public land?

Hi there. This shelter/pavilion/gazebo is correctly marked but it’s in someone’s back yard, behind a fence.

I’m new here but it feels to me that this might be misleading. If I were to seek shelter, and follow the map, I would be disappointed by the lack of an available shelter.

What is the protocol in this situation?

It should have the tag access=private added to it, to denote that it’s not accessible to the public.
