Is transit really banned for cyclists and others on `highway=living_street`? [solved: yes, it is]

=destination access value means that anyone can use, but transit is banned. So you are not allowed to use it to take shortcuts.

OSM tags for routing/Access restrictions - OpenStreetMap Wiki claims than in Ukraine, unless tagged otherwise it applies to various transport modes, including cyclists

It was added long time ago by XAN without stating any source or explanation. I asked them at User talk:XAN - OpenStreetMap Wiki but as expected I got no reply.

Is it actually illegal for cyclists (and motor vehicles) to take this route ?

Wiki claims that Way: 1102186756 | OpenStreetMap is banning transit for anyone except psv and pedestrians (as various access supposedly default to =destination)

maybe this =destination should be actually =yes ?

Note that Ukraine is sole listed area in the entire world where access for cyclists on living_street is supposedly defaulting to =destination

if that is actually true: which law states this? Would it be possible to either add source for this claim or would it be fine to remove it from wiki?

Disclaimer: this “OSM tags for routing/Access restrictions” page is of dubious authority, utility and I consider it to not be really useful. But outright mistakes would be maybe worth fixing.

I am not very familiar with this topic, but it seems that the tag highway=living_street is used only for roads marked with sign 5.34 — Residential Zone. In most cases, such a sign is absent, and the appropriate tags should be highway=service, service=*.

Perhaps someone more knowledgeable than me will join this discussion. Below are excerpts from the Resolution of the Cabinet of Ministers of Ukraine “On the Road Traffic Rules” — what I found related to residential zones (a machine translation):

1. GENERAL PROVISIONS

1.10. Terms used in these Rules have the following meanings:

bicycle — a vehicle, except wheelchairs, driven by the muscular power of a person located on it;

residential zone — courtyard areas, as well as parts of settlements marked with road sign 5.34;

8. Traffic Regulation

8.4. Road signs (Appendix 1) are divided into groups:

g) informational and directional signs. They introduce or cancel certain traffic regimes and also inform road users about the location of settlements, various objects, and territories where special rules apply;

12. SPEED

12.5. In residential and pedestrian zones, the speed must not exceed 20 km/h.

26. TRAFFIC IN RESIDENTIAL AND PEDESTRIAN ZONES

26.1. Pedestrians are allowed to move in residential and pedestrian zones both on sidewalks and on the carriageway. Pedestrians have priority over vehicles but must not create unjustified obstacles to their movement.

26.2. In a residential zone, it is prohibited:

a) transit traffic of vehicles;

b) parking of vehicles outside designated areas and their placement in a way that obstructs pedestrian movement or the passage of emergency or special vehicles;

c) parking with the engine running;

d) driving instruction (training driving);

e) movement of trucks, tractors, self-propelled machines and mechanisms (except those servicing facilities and citizens, performing technological work, or belonging to citizens residing in this zone).

26.3. Entry into a pedestrian zone is permitted only for vehicles servicing citizens and enterprises located in that zone, as well as vehicles belonging to citizens who reside or work in that zone, or vehicles (motorized wheelchairs) marked with the identification sign “Driver with disability”, driven by drivers with disabilities or drivers transporting passengers with disabilities. If there are other access routes to the objects located in this area, drivers must use only those routes.

26.4. When exiting a residential or pedestrian zone, drivers must yield to other road users.

Section 6.7 of these Rules states that

Cyclists must comply with the provisions of these Rules that apply to drivers or pedestrians and do not conflict with the provisions of this section.

In Ukraine, the equivalent of “living street” is “residential zone.” (Житлова зона)

Section 26 of the Rules governs the conduct of road users in residential areas, with subsection 26.2(a) prohibiting through traffic for vehicles.

Section 1.10 contains a glossary of terms used in the Rules

residential zone — courtyards, as well as parts of populated areas marked with traffic sign 5.34 “Residential Zone”;

a bicycle is a vehicle, other than a wheelchair, propelled by the muscular power of the person riding it;

vehicle — a device designed to transport people and/or cargo, as well as any special equipment or mechanisms installed on it;

Therefore, based on the above, it follows that a bicycle is a vehicle, and through traffic by vehicles is prohibited in residential areas (including bicycles).

Persons driving hoed-drawn vehicles and animal drivers are obliged to comply with the requirements of other clauses of these Rules relating to drivers and pedestrians and do not contradict the requirements of this section.

There’s no horse rider definition in the Rules.
