How should i tag a path/road that from one way is access=private and from the other access=permissive?

I’ve encountered this situation while doing survey few times:

  • a path that you can enter from one way with no sign or barrier, and from other way there is a “no trespassing” sign
  • apartment complex (few residential buildings) behind a fence, but one gate is open with no lock (always unlocked/open)
  • landuse=allotments when you can access it via informal path from one way, but you can’t from regular gates.

In all of this cases there is no legal way to access it via car so motor_vehicle=private. But should foot and bicycle be also private? I tag it as permissive, sometime adding a description from which direction you can access it. Am I doing this correctly?

One case I see that probably should be private for all: a path from which one way you can access it illegally crossing railway tracks, and from other way no trespassing sign on jersey_barrier. It should be private, right? Given per wiki access tags describe legal right of way.

In case where main entrance was gated and back/secondary open, I typically tagged short stretch around gate/sign as access=private and without restriction elsewhere

in case where it was clearly someone breaking fence (often with other gaps already repaired) I tagged entire thing as access=private

I seen such cases where they were defending parking spaces - I put vehicle=private on them. Sometimes with bicycle=yes
